TERMS OF SERVICE FOR PRIVATE COMMISSIONS

If you have any concern with the following statements, you may request a change if discussed with us prior to payment for your piece.

1. GENERAL TERMS

  • We will not take part in the production of hateful or illegal content of any kind.

  • All illustrations will include a watermark signature or the GVS logo that may not be removed.  

  • We may record the process of the drawing for educational purposes and youtube uploads.  

  • Prices are subject to change based on demand but are otherwise non-negotiable.  

  • We reserve the right to turn down an order that does not fit with GVS content standards.

  • We will not draw characters belonging to other people without their expressed consent.

  • We will not make art pieces based off real people.

  • Characters without any visual reference will have an added charge of 50% of the base price.

  • Lowered pricing is available for extra characters that only applies if the characters are grouped together or interacting.

  • A maximum of 3 characters may be requested per single image on any piece.

2. PAYMENT

  • All payments are charged in USD

  • Currently we accept payments through PayPal invoice only. You must provide your paypal e-mail so that we may send you the invoice.

  • Commissions can be paid in their totality upfront or split 50% upfront and 50% after base sketch approval.

  • Refunds will not be issued beyond base sketch approval. (please see our refund policy for further information in point 7)

  • We will not accept any payment before a commission has been agreed upon by both parties.

3. PROCESS AND DELIVERY

  • Once a commission is accepted and payment has been processed we will begin working on rough pose sketches.

  • While we work on your piece, we will reach out to you for reviews so that we may achieve a satisfactory base sketch. Note that any major changes to pose and or details must be worked out at the sketch stage.

  • Once the sketch is approved, payment will be expected in full.

  • Please note that the images sent for review will be smaller than the finished piece and will have a watermark on top.

  • The commission duration will greatly depend on your promptness to respond to emails with our updates. Generally it will not exceed from 1 week to 2 months. You can also opt to receive messages through direct messaging through twitter or discord.

  • Any unforeseen delays with your commission will be brought to your attention immediately.

  • When the piece is finished you will receive a full resolution image by email or a Dropbox link, depending on the size, plus a smaller resized image for ease of sharing.

4. REVISIONS

  • Extra fees will be applied if any changes are required beyond the finished lineart stage depending on the complexity of the change requested.

  • Any alternate versions will be charged separately and will be estimated on an hourly rate of $20USD/hr.

  • Please note that complete overhauls during the sketching stage will also result in extra charges. It is important to carefully select a pose, and then review the base sketch carefully to avoid major delays and changes.

5. COPYRIGHT / USAGE POLICY

  • I, Daniel Santander and or Ellen Santander (the artists), claim the rights to the produced drawing, not the buyer. Therefore I am allowed to use the copyrighted artwork to:

    • Promote ourselves with it on social media.

    • Publish books featuring the artwork (artbooks, prints etc.)

    • Display it anywhere to our discretion (website, social media, etc.)

    • Post it publicly anytime.
       

  • The buyer is allowed to:

    • Use the commissioned piece for personal use unless agreed otherwise (you may upload it on all your social media profiles, forums, etc.)

    • Print the artwork and claim the character(s) as their own, but not the artwork itself.

    • Use the artwork to promote themselves. You are not required to give me credit when you post it but it is very appreciated.

    • Use the artwork on their Youtube channel and in monetized videos as long as the artwork itself is not the main subject for the earnings.
       

  • The following is considered copyright infringement:

    • Reproducing/using the copyrighted artwork commercially - making money off it in any way.

    • Claiming the artwork as your own or being produced by you.

    • Removing our signature or logo from the artwork.

    • Altering the artwork or tracing over it without our consent.
       

  • We reserve the full rights to the artworks and it's use/distribution unless otherwise agreed upon (rights to the image for your own non-personal use may be purchased at any time for commercial use).

6. CUSTOMER SATISFACTION

  • We are always available through email, for questions and inquiries about your work.

  • If there are any problems regarding the commissioned piece, please let us know right away so that we may find a solution together.

  • We are willing to change some of our terms for you if it is discussed before the commission is started.

7. REFUND / CANCELLATION POLICY

  • The buyer may not request a refund once we begin working on the commission. You will be notified before the work is begun.

  • If we are, for any reason, unable to start your commission, you will receive a full refund. 

  • If you cancel your order before we begin, you will receive a full refund.

  • If you are eligible for a refund, do not request a Paypal chargeback. We will transfer the funds back to you directly within 24 hours. 

  • If a Paypal chargeback is issued, at any point beyond the base sketch approval, you will lose all before mentioned rights to the commissioned piece, and we will hold full rights to profit further from it in any way available to us. We will decline the chargeback and supply Paypal with our conversations in which the commission is discussed as evidence that we have completed work for you in accordance to our guidelines. Furthermore, you will also be blacklisted from commissioning us again.​

WHAT WILL YOU RECEIVE THROUGH EMAIL/DROPBOX LINK?

  • Drafts/mockup poses for review and approval (depending on the complexity of the piece there might be fewer or more drafts)

  • A base sketch that must be approved before moving onto final linearts and colors.

  • A rough color scheme and palette that suits your piece.

  • Full-resolution file (ranging from approx. 2k to 4.5k at 300 DPI) of final drawing and a smaller version for ease of sharing. All file formats will be PNG.
